CUSTOMER RULES

Please take a few minutes to read these rules, and the Terms of Use of the SortedApp application (Click To See) which together govern your use of the App. Please take particular note of the disclaimers of our liability, which are highlighted in bold below.

By clicking on the “I Accept” button on this form, you agree to be bound by these Hirer’s Rules and the terms of use of the SortedApp application. We may terminate your account with us at any time and without notice if you breach any of these rules or any terms of use.

Interpretation

we may refer to you as a “Hirer” who is a person who has registered with us to post one or more Tasks on our App from time to time and who may select a Sorter to sort a Task; references to “we”, “us” or “SortedApp” mean SortedApp Ltd who operate the mobile app or website sortedlocal.com; a “Sorter” is a person who may sort your Task; a “Task” is an errand or odd job which a you would like somebody to carry out for you; the “App” is the mobile app or website sortedlocal.com.

About us and our App

We provide a peer-to-peer platform which aims to bring together Hirers and Sorters. When you post a Task, the App will provide you with a list of Sorters that meet your search criteria. It is your responsibility to choose a Sorter that meets your requirements and you acknowledge that our search tool is only provided to assist you in this selection process. We make no promises as to the suitability of any Sorter shown in our search results to perform any Task.

All communications about a Task take place between you and the Sorter directly. We make no promises, representations or guarantees in respect of the information provided to you by any Sorter.

We do not make any guarantee to you that a Sorter will accept or complete your Task or that their work will be satisfactory to you. You agree that any goods or products provided by a Sorter as part of a Task are received at your own risk. We are not responsible for and make no promises as to the quality or fitness for purpose of any goods or products received. You are solely responsible for ensuring that a Sorter completes your Task to your satisfaction.

About you

You must be over 16 to use the App and to post Tasks.

When you register with us as a Hirer, we ask you to confirm your identity. You confirm that all documents and any information which you provide to us are true and accurate and you agree to inform us promptly of any change to the information that you provide.

We hold and use any information that you provide to us in accordance with our privacy policy (Click To See).

If you are under 18, over 60, or suffering from an illness or disability, we recommend that you only use Sorters that have provided confirmation of the credentials listed in their profile and two reference checks. We will request these documents and references from Sorters and we will indicate on a Sorter’s profile where these have not been obtained.

Posting Tasks and Ratings

Your post must not include any wording which may be offensive to others, or discriminatory in respect of any other person. When you select a Sorter to carry out your Task, you must not discriminate on grounds of race, gender, sexual preference, age or disability.

You must not use the App to post any Task which is illegal or is of immoral nature.

Your post must include sufficient details to inform Sorters about the nature and location of the Task, any skills or qualifications that may be required, any health and safety risks involved in completing the Task, and your estimation of the time to complete the Task. The amount that you pay the Sorter should be reasonable in respect of the time that your Task might take to complete and it is your responsibility to comply with all laws and regulations relating to the minimum wage that you are required to pay a Sorter.

When you rate a Sorter through our App you should be truthful. You must not be defamatory or offensive about any Sorter. You may be liable to a Sorter if you publish untrue, defamatory or offensive statements about them.

Choosing a Sorter

You must ensure that a Sorter has the necessary ability, skill and qualifications and any other credentials required by law or otherwise to complete your Task safely and to a satisfactory standard before you agree to work with them.

Whilst we will use our reasonable endeavours to obtain copies of any qualifications, certificates, registrations, memberships or authorisations that a Sorter claims to possess and two character references for that Sorter, where we indicate on a Sorter’s profile that we have not received either of these, that Sorter may not have the credentials listed on their profile and you should take appropriate steps to confirm these credentials with the Sorter before allowing them to complete your Task.

You may request copies of any qualifications, certificates, registrations, memberships or authorisations that have been provided to us by a Sorter. We will use our reasonable endeavours to provide you such copies within a reasonable time of your request.

Tools and Property

Where appropriate, your post should state whether you will provide tools for the Sorter to use in completing the Task. Tools should always be safe and appropriate for use to carry out the Task.

Where your Task requires a Sorter to enter your home, garden or other property or land owned or occupied by you, you are responsible for the safety of the Sorter at all times. You should ensure that your property is reasonably safe. If there are any hazards or risks about a your property or a specific Task, you should let the Sorter know about these before he or she enters your property or starts work on the Task.

You may be directly liable to a Sorter if they suffer injury as a result of your home, garden property or tools being unsafe or inappropriate for use.

Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT RESPONSIBLE FOR ANY INJURY, DAMAGE TO ANY PROPERTY OR ANY OTHER LIABILITY, LOSS OR DAMAGE WHICH YOU, A SORTER OR ANY THIRD PARTY MAY SUFFER AS A RESULT OF ANYTHING THAT YOU DO OR FAIL TO DO IN CONNECTION WITH:
YOU POSTING A TASK OR RATING A SORTER, OR THE CONTENT OF ANY POST OR RATING PUBLISHED BY YOU ON OUR APP;
THE SEARCH RESULTS DISPLAYED BY OUR APP;
THE CONTENT OF ANY SORTER’S PROFILE OR ANY REPRESENTATIONS, PROMISES OR STATEMENTS MADE BY A SORTER;
YOUR SELECTION OF A SORTER, OR ANY WORK CARRIED OUT BY A SORTER, OR ANY GOODS OR PRODUCTS PROVIDED TO YOU BY A SORTER, IN RESPECT OF ANY TASK;
ANY TOOLS OR MATERIALS USED BY A SORTER IN COMPLETING ANY TASK
YOUR HOME, GARDEN OR ANY OTHER PROPERTY OR LAND OWNED OR OCCUPIED BY YOU, OR ANY TOOLS OR MATERIALS WHICH YOU ALLOW A SORTER TO USE IN COMPLETING ANY TASK.
IN THE EVENT THAT WE ARE FOUND BY A COURT OF LAW TO BE LIABLE TO YOU IN CONNECTION WITH YOUR USE OF THE APP, OUR LIABILITY TO YOU WILL BE LIMITED TO THE LESSER OF THE SUM OF £200 OR THREE TIMES THE VALUE OF THE TASK TO WHICH THE LIABILITY RELATES.

YOU AGREE TO REIMBURSE US FOR ANY LIABILITIES, COSTS, EXPENSES, DAMAGES AND LOSSES INCURRED BY US AS A RESULT OF A BREACH OF THESE RULES OR OUR TERMS OF USE BY YOU.

Payments

The payment which you offer to a Sorter includes the payment which the Sorter will receive plus our fee for posting your Task. Our fees are set out below.

£4 Booking Fee Applies To All Tasks

When your Task is posted, the payment will be adjusted to show what the Sorter will actually receive and you are responsible for payment of that amount to the Sorter upon completion of the Task. You become responsible to us for payment of our fee as soon as your Task is posted, regardless of whether the Sorter completes your Task to your satisfaction. If you are not satisfied with the Sorter’s work, you will not be entitled to any refund of any fees that you have already paid to us.

We may hold your payment on your behalf in a secure account until you confirm to us that the Sorter has sorted your Task to your satisfaction. You may instruct us to withhold payment to any Sorter if they have not done a good job. However, you are solely responsible for settling any dispute or argument over payment with a Sorter. If we are ordered to pay any money to a Sorter or other person in respect of your task, you must pay to us an amount equal to the payment we have been ordered to make to the Sorter or other person.

We may, if you request us to do so, agree to assist you in resolving any dispute over payments in accordance with our dispute resolution procedure (Click To See)

We will use reasonable endeavours to ensure that your Sorter profile is included in search results where it matches the search criteria entered by a Hirer. We do not make any promises that your profile will be displayed in any search results or that you will be invited by any Hirer to sort any Task.

All communications about a Task take place between you and the Hirer directly. We make no promises, representations or guarantees about any information provided by any Hirer about any Task including (without limitation) the nature, quality, timing, or suitability of the Task. If you are selected by a Hirer to carry out any Task, you are responsible for ensuring that you confirm all of the details relating to any Task before you agree to do it.

About you

You must be over 16 to use the App and to sort Tasks.

When you register with us as a Sorter, we ask you to confirm your identity. We will also ask you to provide us with

a short CV describing your training and experience, qualifications, registrations and memberships with professional bodies, and authorisations and copies of any certificate or other document confirming these, and

2 character references from people who are not related to you.

You confirm that all documents and any information which you provide to us are true and accurate and you agree to inform us promptly of any change to the information that you provide.

Carrying out Tasks

You should carry out any Task that you accept carefully, in accordance with the Hirer’s request, and make all reasonable efforts to do a good job. You must take care not to damage or lose any Hirer’s tools or property. If you are invited to a Hirer’s home, garden or other property to carry out a Task, you must take care not to cause any damage to the property, or to any contents or personal belongings of the Hirer or any other person.

If a Hirer requires you to use your own tools or materials to complete a Task, you must ensure that your tools, materials and anything else used in the course of carrying out the Task are in good condition, are suitable for the Task and are not likely to cause injury or damage the Hirer’s property or that of any third party. You may be directly liable to a Hirer or third party if they suffer injury as a result of your tools being unsafe or inappropriate.

If you provide any goods or products as part of a Task that you carry out, you are responsible for and agree to ensure that such goods and products are of satisfactory quality, fit for their purpose and comply with all applicable laws and regulations.

Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT RESPONSIBLE FOR ANY INJURY, DAMAGE TO ANY PROPERTY OR ANY OTHER LIABILITY, LOSS OR DAMAGE WHICH YOU, A HIRER OR ANY THIRD PARTY MAY SUFFER AS A RESULT OF OR IN CONNECTION WITH:
THE CONTENT OF ANY POST OR RATING PUBLISHED ON OUR APP BY A HIRER;
THE SEARCH RESULTS DISPLAYED BY OUR APP;
THE DETAILS OF ANY TASK ENTERED BY A HIRER;
YOU BEING SELECTED BY A HIRER TO CARRY OUT ANY TASK OR FOR YOUR WORK IN RESPECT OF ANY TASK, OR FOR ANY TOOLS OR MATERIALS USED BY YOU TO COMPLETE A TASK, OR FOR YOU PROVIDING ANY GOODS OR PRODUCTS AS PART OF A TASK;
YOU ENTERING INTO ANY HIRER’S HOME OR GARDEN, OR ONTO ANY OTHER PROPERTY OR LAND OWNED OR OCCUPIED BY THEM;
YOUR USE OF ANY TOOLS OR MATERIALS MADE AVAILABLE TO YOU BY A HIRER OR OTHERWISE USED BY YOU IN CARRYING OUR ANY TASK;
IN THE EVENT THAT WE ARE FOUND BY A COURT OF LAW TO BE LIABLE TO YOU IN CONNECTION WITH YOUR USE OF THE APP, OUR LIABILITY TO YOU WILL BE LIMITED TO THREE TIMES THE VALUE OF THE TASK TO WHICH THE LIABILITY RELATES, UP TO A MAXIMUM OF £200.

YOU AGREE TO REIMBURSE US FOR ANY LIABILITIES, COSTS, EXPENSES, DAMAGES AND LOSSES INCURRED BY US AS A RESULT OF YOUR BREACH OF THESE RULES OR OUR TERMS OF USE.

Payments to you

We do not charge you any fee or commission for using the App or for introducing you to a Hirer except as set out below.

All payments are made to you directly from a Hirer. However, you acknowledge and agree that we will hold your payment on the Hirer’s behalf in a secure account until the Hirer confirms to us that you have sorted their Task to their satisfaction. Payments to you may depend on the quality of your work. Payment may be withheld on instruction from the Hirer if they are not satisfied with your work. We have no responsibility for paying you for any Task and any dispute over payment is between you and the Hirer.

We may, if you request us to do so, assist you in resolving any dispute over payments in accordance with our dispute resolution procedure (Click To See).

WE WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE WHICH YOU MAY SUFFER AS A RESULT OF YOUR FAILURE TO RECEIVE PAYMENT FOR WORK WHICH YOU HAVE CARRIED OUT IN RESPECT OF ANY TASK, WHETHER OR NOT YOU PERFORMED THE WORK SATIFACTORILY.

Tax, National Insurance and Benefits

You are solely responsible for paying any tax or National Insurance contributions which may be due on any payment which you receive from a Hirer. We are not able to offer you any advice as to whether tax or National Insurance will be payable, so please check with Her Majesty’s Revenue and Customs (HMRC) if you are in any doubt.

If you use the App regularly to sort Tasks, the money that you receive may affect any jobseekers allowance or other benefits which you are entitled to claim. You are solely responsible for keeping your local Jobcentre Plus or other appropriate authority updated about your status and any income which you receive.

WE WILL NOT BE LIABLE TO YOU FOR ANY CLAIMS, LIABILITY, LOSS, DAMAGE OR FINES WHICH YOU MAY SUFFER OR INCUR AS A RESULT OF YOU AGREEING TO SORT TASKS AND RECEIVING PAYMENT FOR THEM. IF WE ARE REQUIRED TO MAKE ANY PAYMENT TO HMRC OR ANY THIRD PARTY, AS A RESULT OF YOUR FAILURE TO PAY TAX OR NATIONAL INSURANCE, OR IN RESPECT OF YOUR ENTITLEMENT TO BENEFITS, YOU WILL IMMEDIATELY REIMBURSE US FOR THE FULL AMOUNT OF THAT PAYMENT.
